Bombay High Court’s Orders in City Realcom Liquidation

In October 2024, the Bombay High Court issued an important ruling to streamline the handling of thousands of claims related to City Realcom Limited, a company under liquidation. This decision not only impacts the Official Liquidator managing the liquidation but also clarifies the next steps for claimants and how the claims process will proceed under legal oversight.

Background of the Case

City Realcom Limited has been under liquidation for several years, with numerous financial claims still unresolved. When a company goes into liquidation, an Official Liquidator (OL) is appointed by the court to oversee the company’s remaining assets and liabilities. The role of the OL in this case is to manage the claims of creditors and investors who are owed money by City Realcom. To date, the court has received around 70,000 claims related to City Realcom, showing the complexity and scale of this liquidation process.

Key Orders from the Court

Here’s a breakdown of the major orders from the High Court that will impact the liquidation process:

  • Scanning and Inventory of Claims:

      • The court has permitted the Official Liquidator to seek quotations from e-service providers for scanning and inventorying the claims. This digital inventory will ensure a secure record of all claims before the originals are sent to the Maharashtra Protection of Investor Depositors (MPID) Court.
      • The OL will choose the e-service provider with the lowest bid, using funds from the liquidation to cover these costs.
  • Transfer of Claims to MPID Court:

      • After the scanning and inventorying are complete, all unadjudicated claims will be transferred to the MPID Court, which specializes in protecting investor rights.
      • Claims submitted after August 2018 will also be handed over to the MPID Court to streamline the process and reduce redundancy.
  • Purchase of Supplies for Document Storage:

To facilitate the physical transfer of claim documents, the OL has received approval to purchase 100 carton boxes. This ensures that all claims are securely transported to the MPID Court.

  • Direct Claim Submission for Future Claimants:

For new claims, the court has simplified the process by allowing creditors to file directly with the MPID Court. Notices will be uploaded on various websites, including the Bombay High Court and the Ministry of Corporate Affairs, to inform potential claimants about the new procedure.

Conclusion

This order by the Bombay High Court marks a significant step forward in managing the liquidation of City Realcom Limited. By digitizing records, transferring claims, and enabling direct submission, the court is working to resolve claims more efficiently. The decision is a crucial move toward transparency and efficiency, benefiting both creditors and the legal system.
